KEY INFORMATION ABOUT THE TERMS OF SERVICE AND THE WEBSITE

We realize that reading the full Terms of Service is not the most engaging activity, so for your convenience we have prepared the most important information about our Website.

  1. The Website is operated by Inkubator Rozwoju Åšwidwina, NIP: 6722106277, KRS: 0001069656, with its registered office in Åšwidwin, ul. 3 marca 26, 78-300 Åšwidwin.

  2. The Website is informational and research-oriented. Its purpose is to collect signals of interest and feedback regarding the IMMONA Game concept in two paths:

    1. B2C (IMMONA Game) – a fit survey (approximately 3–5 minutes) and optional signup for the beta waitlist and/or early community (Discord);

    2. B2B (IMMONA Mirror, the /mirror subpage) – a survey for specialists and optional contact details for a conversation or pilot.

  3. The Website does not conduct sales, does not provide user accounts, and does not require the purchase of any products or services. The most important user actions consist of moving to surveys handled in the external Tally tool.

  4. We may use analytics tools on the Website, including Microsoft Clarity. Details of personal data processing and cookies are described in the Privacy Policy & Cookies.

§1.

DEFINITIONS

The terms used in these Terms of Service mean respectively:

  1. Website – the website available at https://immonagame.com and the /mirror subpage, operated by the Operator;

  2. Operator – the entity operating the Website: Inkubator Rozwoju Świdwina, NIP: 6722106277, KRS: 0001069656, with its registered office in Świdwin, ul. 3 marca 26, 78-300 Świdwin;

  3. User – any person using the Website, whether for private or professional purposes;

  4. IMMONA Game – a project under development consisting of an RPG connected with tasks performed by the player in real life. It is intended to maintain consistency and motivation of users in real life and make it easier to achieve intended goals through gamification of development;

  5. IMMONA Game (B2C) – the part of the Website directing users to the B2C survey and waitlist/community activities;

  6. IMMONA Mirror (B2B) – the part of the Website, in particular the /mirror subpage, directing users to the B2B survey and pilot activities;

  7. Survey – a form/survey available to the User in the external Tally tool, to which the Website redirects the User;

  8. Tally – an external tool for creating forms and collecting answers (operator: Tally). Use of the Surveys may be subject to Tally documents, including its privacy policy and DPA;

  9. Waitlist – a list of persons interested in obtaining access to the beta version; signup is made by leaving an email address in the Surveys, optionally;

  10. Community (Discord) – a planned user community; the Discord server may be launched at a later date;

  11. Analytics Tools – solutions used to analyze use of the Website, including Microsoft Clarity;

  12. Privacy Policy – the document describing the rules for processing personal data and cookies in connection with the Website: [LINK];

  13. Newsletter – free email messages sent by the Operator to a User who has given separate consent, containing information about the IMMONA Game or IMMONA Mirror project, including beta, tests, community, and product development, and in the future also commercial information about products or services related to this project;

  14. Civil Code – the Act of April 23, 1964 – Civil Code (Journal of Laws of 2025, item 1071).

§2.

GENERAL PROVISIONS

  1. These Terms of Service define the rules for using the Website, including in particular the rules for redirection to Surveys and for Users contacting the Operator as part of research/prototype activities of the IMMONA Game project.

  2. The Website is free of charge and does not sell products or services through the Website. The Website does not provide user accounts.

  3. Information presented on the Website is informational and concerns a concept developed as an experiment/validation of assumptions (Business Model Canvas). The Operator may change the content of the Website, Surveys, and test assumptions.

  4. The Terms of Service are made available free of charge on the Website in a way that allows them to be obtained, reproduced, and recorded.

  5. Information provided on the Website does not constitute an offer within the meaning of Article 66 of the Civil Code.

§3.

COMMUNICATION WITH THE OPERATOR

  1. Users may contact the Operator electronically by sending email messages to: office@immonagame.pl.

  2. The Operator does not charge additional fees for contact. Any costs incurred by the User result from the User’s agreements with telecommunications or internet service providers.

§4.

WEBSITE FUNCTIONALITIES

  1. The Website enables in particular:

    1. reading the description of the IMMONA concept and informational materials, including video materials;

    2. moving to Surveys (B2C or B2B) carried out in Tally;

    3. moving to the /mirror subpage (IMMONA Mirror);

    4. moving to external profiles, such as LinkedIn, if made available on the Website.

  2. Links leading to Surveys may contain parameters, such as the identifier of the selected scenario or source of entry, which help the Operator analyze the results of the experiment.

§5.

SURVEYS (TALLY) AND RULES FOR PROVIDING DATA

  1. Surveys are made available in the external Tally tool. By moving to a Survey, the User also uses third-party solutions, which may be connected with separate Tally rules.

  2. Participation in Surveys is voluntary. The User may provide answers without giving contact details if the Survey allows that variant.

  3. Contact details, such as an email address or phone number, are collected only when the User decides to provide them, for example to receive contact regarding the beta, pilot, or a conversation.

  4. When completing a Survey, the User should provide only content related to its purpose and subject and refrain from introducing unlawful content or content infringing third-party rights. In particular, it is prohibited to provide false or misleading content, unlawful content, content unrelated to the Survey, third-party personal data without an appropriate basis, special categories of data unless expressly requested, offensive content, or unsolicited commercial content.

  5. The User may not introduce into the Website or Survey illegal content or content relating to illegal activities, including public insult based on national, ethnic, racial, or religious affiliation or lack of religion, content that may facilitate a terrorist offense, or pornographic content involving a minor.

§6.

TECHNICAL REQUIREMENTS

  1. To use the Website, the User needs a device with internet access, a current web browser, and an active internet connection.

  2. To use some functionalities, including Survey forms, it may be necessary to enable JavaScript and cookies.

  3. The Operator takes reasonable measures to ensure proper operation of the Website but does not guarantee uninterrupted or error-free availability, in particular due to maintenance, updates, failures, or third-party services.

§7.

NEWSLETTER AND CONTACT

  1. If a User gives separate consent, the Operator may send a newsletter or project-related information to the email address provided by the User.

  2. Consent is voluntary and may be withdrawn at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.

  3. The newsletter may contain information about IMMONA Game, IMMONA Mirror, tests, beta access, community, product development, and in the future commercial information concerning products or services related to the project.

§8.

INTELLECTUAL PROPERTY

  1. Materials available on the Website, including text, graphics, trademarks, designations, video materials, layout, and the IMMONA Game and IMMONA Mirror concepts, may be protected by copyright, industrial property rights, or other rights.

  2. Use of the Website does not transfer any rights to the User. The User may use Website materials only for personal use, unless the Operator grants separate consent or applicable law provides otherwise.

  3. It is prohibited to copy, distribute, modify, or use Website materials beyond permitted personal use without the Operator’s prior consent.

§9.

ANALYTICS TOOLS AND COOKIES

  1. The Operator may use analytics tools, including Microsoft Clarity, to analyze the way Users use the Website, improve the Website, and validate the project concept.

  2. Details concerning cookies, analytics tools, personal data processing, and User rights are described in the Privacy Policy & Cookies.

§10.

COMPLAINTS AND IRREGULARITIES

  1. Users may report complaints or irregularities concerning the Website by email at office@immonagame.pl.

  2. The report should describe the issue and, if possible, include information enabling the Operator to identify it.

  3. The Operator will respond to reports within a reasonable time, taking into account the nature of the Website and the research/prototype stage of the project.

§11.

LIABILITY

  1. The Website is informational and research-oriented. It does not provide medical, psychological, therapeutic, legal, or financial advice.

  2. Information on the Website and in Surveys is not a diagnosis, therapy, or recommendation replacing consultation with a qualified specialist.

  3. The Operator is not responsible for third-party services, including Tally, Discord, LinkedIn, YouTube, or other external services to which links or embeds may lead.

  4. The User uses the Website and external services at their own responsibility, subject to mandatory provisions of law.

§12.

AMENDMENTS TO THE TERMS OF SERVICE

  1. The Operator may amend these Terms of Service, in particular due to changes in the Website, Surveys, project assumptions, legal requirements, or technical solutions.

  2. The current version of the Terms of Service is published on the Website.

  3. Amendments apply from the date indicated in the amended Terms of Service, unless mandatory provisions of law require otherwise.

§13.

FINAL PROVISIONS

  1. Polish law applies to these Terms of Service, subject to mandatory provisions of law applicable to Users.

  2. In matters not regulated by these Terms of Service, generally applicable provisions of Polish law apply, including the Civil Code.
